These terms and conditions form a legal contract between you and Memory Angel for your use of the Memory Angel service, accessed via memoryangel.com and the Memory Angel Android application.
By using Memory Angel, you accept these terms and conditions. When you register with Memory Angel, you accept the general terms of use, and the specific conditions that apply to your type of registration. You may wish to print this page for your reference.

GENERAL TERMS OF USE
Your rights of use
You have the right to access and use Memory Angel provided you comply with these terms and conditions. If you breach any part of these terms and conditions, we reserve the right to cancel your access to Memory Angel.
The functionality of Memory Angel is for your personal use only. You must not share this service with any other person or organisation. Special conditions apply for organisations that wish to provide access to Memory Angel to their members or employees. Please address all requests for organisation memberships to info@memoryangel.com.
You agree not to interrupt or attempt to interrupt the operation of memoryangel.com in any way.
Copyright
With the exception of content you create on Memory Angel, Memory Angel owns the copyright for all content on memoryangel.com, unless stated otherwise.
Newsletters
All registered Memory Angel users will automatically receive our "What's New" newsletter.
To remove yourself from any of the newsletters, click on the link at the end of each newsletter and follow the instructions.

No liability for damage
We will use our best efforts to keep memoryangel.com free from viruses and errors. However, we do not accept liability for any damage or loss caused to your computer hardware, software, Internet connections or other peripherals as a result of your use of memoryangel.com.

When you register with Memory Angel, including as a trial or subscribed user, you will be set up with a Carer account. All personal information we collect about you passes through our secure server.

Credit card information security policy
Memory Angel uses the DPS Payment Express Payment Gateway for its online credit card transactions. DPS processes online credit card transactions securely for thousands of merchants globally, providing a safe and secure online payment service.
- Payments are processed in real-time
- Memory Angel does not have access to your full card number, this credit card payment is secured by DPS
- DPS have bank grade security. All transaction details are stored in their PCI-DDS compliant Data Centre
- DPS Payment Express Software is certified with over 200 banks globally

Changes to terms and conditions
We may change these terms and conditions at any time. Each time you use memoryangel.com you are agreeing to the terms and conditions applicable at that time. We provide a link to these Terms & Conditions at the bottom of every page of the website.
Jurisdiction
The laws of New Zealand apply to these terms and conditions. Any dispute arising in relation to these terms and conditions will be resolved in accordance with New Zealand law.
Consumer Guarantees Act
Nothing in these terms and conditions limits your rights under the Consumer Guarantees Act 1993.

BUYING PRODUCTS ONLINE
Subscriptions to Memory Angel can be purchased online.
Prices
All prices are stated in New Zealand dollars (NZD), and include Goods and Services Tax (GST).
Price changes
We reserve the right to increase fees or to introduce new prices for our products and services at any time. Any such changes will be published in advance on memoryangel.com.
Methods of payment
Payment for all purchases made online is by credit card only. Your account will be charged in NZD.
Payment
Payment for the selected subscription term is processed at the time of purchase.
Refund Policy
The online credit card payment facility enables customers to pay Memory Angel for the services provided.
All subscriptions payments made using this online credit card facility are paid in advance for the upcoming period of use.
Refunds cannot be made against these payments, unless there is a significant error with the services that prevents your effective use of the service.
Request for such refunds should be via email to support@memoryangel.com.
Your personal information
You agree to provide us with accurate and complete personal information necessary to activate your subscription. This includes:
- Your name
- Email address
- Credit card number, type, the name on your card, and the expiry date

Your obligations
You agree not to sell, assign or transfer your rights as a Memory Angel customer.
You agree to pay the subscription fee published on memoryangel.com, and any other charges (including Internet connection charges) you incur in order to access memoryangel.com.
Your username and password
As part of the registration process, you will use your email address as a username and select a password. You will use your username and password to gain access to memoryangel.com.
When your subscription begins
When your subscription has been processed and your payment has been received, we will confirm by:
- A Confirmation of Order message displaying on your computer screen, which you should print out; and
- A Confirmation of Order email message sent to the email address you have supplied.
Your subscription to Memory Angel begins from the date on this Confirmation of Order message.
Security and unauthorised use
You must keep your username and password confidential. You are responsible for ensuring there is no unauthorised use of memoryangel.com under your username and password.
You agree to notify us promptly if:
- You suspect unauthorised use of your memoryangel.com access or;
- Know or suspect loss or disclosure of your username or password.
You are liable for any unauthorised use of your online access until you notify us and update your username and password.
Updating your personal information
If any of your personal information changes, you agree to notify us promptly by logging into memoryangel.com and updating your profile.
Contacting you
You agree that we may contact you to notify you about:
- Your use of Memory Angel
- Changes to the Memory Angel service
- Changes to these terms and conditions
- New Memory Angel products, services and promotions; and
- Any other information necessary for the operation and security of Memory Angel.
You agree that we may contact you within a reasonable timeframe after your subscription has ceased from time to time to notify you about Memory Angel services and promotions until you let us know you wish to opt out of these notifications.
Renewing your subscription
Subscriptions are auto-renewing by credit card. We will send you an email reminder before your subscription is due to automatically renew. If you do not wish to renew your subscription, click on the link in the reminder email and follow the instructions.
The renewal fees will be the current published rates for the term of your subscription.
Cancelling your subscription
You may cancel your subscription at any time.
To do this, access "Profile" on memoryangel.com and follow the cancellation instructions.
Except where required by the Consumer Guarantees Act, we do not give refunds for cancelled subscriptions. When you cancel, your access to the Memory Angel service continues until the end of your current paid up period.
You agree that we may contact you within a reasonable timeframe after you have cancelled your subscription from time to time to notify you about Memory Angel services and promotions until you let us know you wish to opt out of these notifications.
Problems with payments
If we cannot charge your credit card account or do not receive payment owing from you, we will contact you at your most recently updated email address.
If we are unable to contact you by email, we reserve the right to suspend or terminate your access to Memory Angel.
FREE TRIAL
Your personal information
You agree to provide us with accurate and complete personal information necessary to activate your free trial. This includes:
- Your name
- Email address;

Your username and password

When your Free Trial begins
When your Free Trial has been processed we will confirm by:
- A Confirmation of Order message displaying on your computer screen, which you should print out; and
- A Confirmation of Order email message sent to the email address you have supplied.
Your Free Trial to memoryangel.com begins from the date on this Confirmation of Order message.
Security and unauthorised use

You agree to notify us promptly if:

Transferring to a subscription
After the notified period of time our Free Trial will expire. Prior to this time we will notify you and provide you with instructions to convert your Free Trial to a subscription.
When you accept this subscription offer your terms and conditions will become the Subscription terms and conditions.
If you do not wish to convert to a subscription your Free Trial account will cease to operate.
Cancelling your Free Trial
You may cancel your Free Trial at any time.
To do this, access "Profile" on memoryangel.com and follow the cancellation instructions.
You agree that we may contact you within a reasonable timeframe after you have cancelled your Free Trial from time to time to notify you about Memory Angel services and promotions until you let us know you wish to opt out of these notifications.
